Election Impacts On Business Immigration: How Companies Can Prepare

Elizabeth Kumbhari is the owner of Go Global Immigration, PLLC, an affiliate law firm of CIBT/ Newland Chase. As we approach November, many corporations are evaluating the possible impacts of the U.S. presidential election. One of the hot topics is U.S. immigration. Understanding how political changes can affect company policies is key to navigating shifts. It's crucial that companies are prepared for any adjustments in U.S. immigration policies that may arise as a result of the election.

Understanding The Immigration System

The U.S. employment-based immigration system is best visualized as a constantly rotating Rubik's Cube. The yellow squares represent company requirements for a role, the percentage of employees who are foreign nationals compared to U.S. citizens and the position type. The red squares depict the backgrounds of non-citizen workers, such as education, nationality, English ability, past visa history and legal history. The green squares represent the federal agencies' enforcement and political atmospheres, including how regulations are implemented by any specific agency, the agency's staffing levels, the adjudicators' training levels and the current administration's duration. The blue squares represent everything else, such as layoffs, hiring practices, flight options, weather patterns, etc.
